I. Scope of the Agreement
1.1 This Aura Sync: Neon Pulse User Agreement (the "Agreement") constitutes a legally binding agreement between you (the "User") and the developer of the game (the "Company," "we," or "Developer") regarding your download, installation, and use of the game Aura Sync: Neon Pulse (the "Game") and related services.
1.2 By downloading, installing, or first launching the Game through app distribution platforms (including but not limited to Apple App Store and Google Play), you acknowledge that you have fully read, understood, and agreed to be bound by this Agreement and the accompanying Privacy Policy.
1.3 If you do not agree to any part of this Agreement, you must immediately cease using the Game. Where platform rules or applicable laws require confirmation of updated terms before continued use, you must complete such confirmation; otherwise, you may not be able to continue using the Game services.
1.4 We reserve the right to revise this Agreement from time to time. Updated versions shall take effect upon publication within the Game or on the official website. You are encouraged to review the latest version regularly.
1.5 We reserve the right, based on operational needs, to modify, suspend, or terminate all or part of the Game services, and may, without prior notice, restrict or terminate your access to or use of the Game.
II. Access to and Use of the Services
2.1 You are responsible for any network communication fees and related equipment costs incurred in connection with your use of the Services.
2.2 By using the Services, you represent that you are at least 13 years old. If you are between 13 and 18 years of age, you may use the Services only after your legal guardian has read, understood, and agreed to this Agreement.
2.3 You assume all risks arising from the download, installation, and use of the Game.
III. Account and Data Management
3.1 The Game is a casual game that does not require account registration to play.
3.2 Game data is primarily stored locally on your device. Uninstalling the Game, clearing cache, or changing devices may result in loss of game progress. To the fullest extent permitted by law, we are not responsible for such loss.
3.3 iCloud Backup Feature (iOS Devices Only): You may choose to use Apple's iCloud service to back up your game progress. This service is independently operated by Apple, and data management is subject to Apple's applicable iCloud terms and policies.
IV. Fees and Virtual Items
4.1 In-game virtual currency (such as coins or gems) may only be obtained through official channels. We reserve the right to remove, without notice, any virtual currency or items obtained through unofficial, illegal, or improper means.
4.2 Virtual currency and items may only be used within the Game and may not be redeemed for legal tender or physical goods, nor may they be transferred or traded.
4.3 We reserve the right, upon reasonable notice, to adjust the types, prices, or functions of virtual currency and items.
V. User Conduct
5.1 Your conduct and any content generated while using the Services must not infringe upon the lawful rights of any third party and must comply with all applicable laws and regulations.
5.2 You agree to adhere to public order, good morals, and relevant codes of conduct. If you violate this Agreement, we reserve the right to take measures including, but not limited to, restricting or suspending your account.
5.3 Any form of cheating is strictly prohibited, including but not limited to the use of unauthorized software, exploitation of game vulnerabilities, interference with normal service operations, or infringement of intellectual property rights.
VI. Intellectual Property
6.1 All intellectual property rights in the Game, including but not limited to source code, object code, documentation, artwork, character designs, and interface layouts, are owned by the Developer. Without our prior written consent, no individual or entity may reproduce, distribute, or otherwise use such content in any manner.
VII. Disclaimer
7.1 The Game is provided on an "as is" and "as available" basis. We make no express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
7.2 We shall not be liable for any losses resulting from force majeure events, third-party service issues, or your improper use of the Game.
VIII. Limitation of Liability
8.1 To the fullest extent permitted by law, we shall not be liable for any indirect, consequential, punitive, or incidental damages arising out of or related to your use of, or inability to use, the Services.
IX. Governing Law and Dispute Resolution
9.1 The formation, validity, interpretation, performance, and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China.
X. Severability
10.1 If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be removed, and the remaining provisions shall remain in full force and effect.
XI. Assignment
11.1 We may assign our rights and obligations under this Agreement to an affiliate or acquirer without your consent. You may not assign any of your rights or obligations under this Agreement without our prior written consent.
